I think this goes down to what state the crime is committed in. In WI yes , the child will face child jail and then prison for two years minimum. We take crimes against animals seriously. So it boils down to the State. Just noticed the article says 18 year old thats a 5 year sentence automatically due to bodly harm with malice and intent.

I don't think he should be jailed for being an asshole. But a few hours of community service at the local animal shelter, might be a fitting lesson. If he is not willing, then throw his ass in jail.
